The instant case is taken up on the prayer of Applicant Bank.
The Applicant Bank has stated that the matter has been settled between the parties and the final total Settlement Amount of Rg.43,00,00,000/- has been deposited by the defendants and legal expenses of Rs.13,85,000/- plus delayed period interest of Rs.1,88,00,000/- to the applicant Bank.
The applicant has placed the application for withdrawal of the aforesaid cases and to list in Lok Adalat. Further, since no further cause of action pending against Borrowers/Defendants, the M. A. No. 223/2022 filed by Jagannath Traders for recall of final order in O. A. 298/2019 has also becOme infructuous.
The application is supported by the Affidavit dated 10/12/2025 of Shri Rajiv Kumar Verma presently posted as Cheif Manager, Union Bank of India at ARB situated at Union Bank Bhawan Near Mantri Awas Vibhuti khand Gomti Nagar Lucknow-226010.
Keeping in view prayer of the Applicant Bank, withdrawal of the O. A. No. 97/2019, and DRC No.700/2023 of OA No.298/2019 is allowed. MA No.223/2022 has become infructuous.
