Counsel for the applicant has filed this Misc. Application in OA no. 417/2020 which was decided by this Tribunal on 17.11.2021. He submits that during this period the applicant bank has taken steps under the SARFAESI Act and has conducted successful auction of the mortgaged property and bank recovered the total dues as per Recovery Certificate, therefore, he prayed that the recovery proceedings pending before the Ld. Recovery Officer in Recovery Certificate No. 416/2021 may kindly be closed and return the original title documents i.e. Exhibit-A/04 to Exhibit-A/06 and Exhibit –A/14 to Exhibit-A/16 .

The Ld. Recovery Officer is directed to close the proceedings of Recovery Certificate No. 416/2021 and Registry is directed to return the original documents i.e. Exhibit-A/04 to Exhibit-A/06 and Exhibit –A/14 to Exhibit-A/16 to the Authorized Officer of the applicant bank after acknowledgement of the same.
Accordingly, file of Misc. Application and Recovery Certificate be consigned to record. Copy of order be uploaded on website and sent to the Ld. Recovery Officer.
