In this matter, counsel for the applicant submits that the counsel for the respondent bank made wrong statement before this Tribunal and he has breach the privilege of communication between the two. There is no breach of privilege as it was common conversation between the two counsels about the matter to be argued on the date and deposit. The cost has not been deposited even today. The counsel for the applicant submits that because of passing of one-week time, they have not deposited the cost.
The averments made in Misc. application are not properly substantiated specially in Para no. 4 the averments are contrary to the records and even today they are not correct.
It is submitted that the order was not uploaded within the prescribed time limit mentioned in the order, subsequently cost could not be deposited. On inquiry from the Registry it is informed that the orders were uploaded on 21.01.2026 at 4:45 PM, therefore, this averment is totally wrong.
Accordingly, this Misc. application stands dismissed. File be consigned to record, as per rules. Copy of order be uploaded on website.
