The defendant^{nos. 2 and 3} on 08.06.2015. stood as^{guarantors.The defendant no'l mortgaged} the said aforesaid^{property. On 24'06'2015 the bank} has obtained^{memorandum of deposit of title deeds} (AD-13) for the aforesaid^{property'The defendant} no.l executed^{the letter of continuity (AD-09)'dated} 08.06.2015^{regarding aforesaidproperty'}

It is^{furthersubmitted that the defendants} enjoyed and^{utilized the Loan facility, but failed to} maintain^{the financial discipline and failed to repay the} due amounts.^{The applicantbank requested the} defendants^{to regularize the loan account by visitsand} letters, but^{there was no response from the} defendants,^{hence the accountwas classifiedas NPA'} Therefore,^{the applicant bank served a demand notice} dated^{03.04.2018 and legal notice dated08'05'2018to} the defendants^{but failed to recover the same Thus'} the^{present O.MI'Ais preferred by the applicant bank} to recover^{its dues.}

On^{notice by this Tribunal, the defendants failed} to^{put appearanceat all, despitepublication'} Accordingly,^{the defendantswere proceeded against} expafte^{on 18.12.2023'}

5.^{The applicant bank has filedevidenceby way of} affidavit^{of Mrs. Aarti Rana, Branch Manager as} documents^{as Annexure-A to Annexure-P which have} gone unchallenged^{and un-rebutted' Hence'the case} of the^{applicant bank stands fully established against} the defendants^with respect^to nonpayment^of gs^- ( outstanding^amount.

After^{perusingthe records,this Tribunal is of} the view that the^{applicant bank has provedits case} beyond reasonable^{doubts.The evidenceand} documents filed^{by the applicant bank not rebuttedby} the defendants by^{not placing any evidenceand there} is no^question of^{disbelievingthe evidenceand} documents filed^{by the applicant bank based upon the} written/printed documents'

In the light of the^{above discussions, the presentT'A'} deserves to^{be allowed.}

ORDER

I hereby allow^{this T.A' of the ApplicantBank and} direct the defendant^{nos. 1 to 3 to pay jointly and} severally to the^{applicant bank within 30 days from} today, a sum of^{Rs'51,82,253/-along with cost,} expenses and^interest @10o/o^{from the date of filing of} this O.A which^{has becomeTA till the date of} realization.

In case of^{failure to depositthe above amount} within the stipulated^{period,the same shall be} recovered from^{the sale of the mortgagedproperty} bearing Flat^{No.SF-01,Second Floor, KhasraNo'834} MIN, 835 MIN,^{836 MIN, Village Dera Mandi, Hauz Khas} (Mehrauli), New Delhi-l10074.^{In case of shortfall, the} same shall be^{recovered from the sale of the personal} movable and^{immovableassets of the defendant nos' 1} to 3.
