sanctioned a^{Car Loan Facilityof Rs'54,00,000/-} on 18.09.2012^{for purchaseof a Mercedes Benz Car'} The defendant^{no'1 throughits duly authorized} signatory and^{managing director i'e', defendant no'2} and defendant^{no.3 in their personalcapacity executed} the documents^{in favour of applicantbankon} 18.09.2012.^{Again, at the request of defendants'the} applicant bank^{sanctioneda Car LoanFacility of} Rs.11,00,000/-^{on 13.08.2015 for purchase of a Verna} Car. The defendant^{no.1 through its duly authorized} signatory and^{managing director i'e', defendant no'2} and defendant^{no.3 in their personalcapacity executed} favour of^{aPPlicant bankon} the documentsⁱⁿ 13.08.2015.

It is^{further submitted that the defendants} enjoyed and^{utilizedthe Loan facilities, but failed to} maintain^{the financial discipline and failed to repay the} due amounts.^{The applicant bank requested the} defendants^{to regularize the loan account by visitsand} letters, but^{there was no response from the} defendants,^{hence the account was classified as NPA in} 10.03.2016.^{Therefore,the applicant bank served a} notice dated^{25,O4.2}l6tothe defendantsbut failed to} recover^{the same.Thus, the present O'A'II-'A' is} preferred by^{the applicant bank to recover its dues'}

On^{notice by this Tribunal,defendantsput} appearance^{throughcounsel but failed to file written} statement^{and the right to file written statement of} defendants^{were closed videgrderdated 14'08'2017'}

The applicant^{bank has filed evidence by way} of affidavit^{of Shri Chandi Kumar,Chief Managerof the} applicant^{bank as Paper No'01to Paper No'360 which} have^{gone unchallengedand un-rebutted'Hence,the} case of the applicant^{bank stands fully established} against the^{defendantswith respect to nonpayment of} outstanding^amount.

After^{perusing the records, this Tribunalis of the} view that the^{applicant bank has provedits case} beyond^{reasonable doubts.The evidenceand} documents^{filed by the applicant banknot rebuttedby} the defendants^{by not placing any evidenceand there} is no^{question of disbelievingthe evidenceand} documents^{filedby the applicant bank based upon the} written/Printed^documents.

In the light^{of the above discussions, the presentT'A'} deserves^{to be allowed.}

ORDER

I^{hereby allow this T'A' of the ApplicantBank and} direct the^{defendantnos' 1 to 3 to pay jointly and} severally to^{the applicant bank within 30 days from} today, a^{sum of Rs.21,98,38,3231' along with cost'} expenses^{and interest @ 11'650/ofrom the date of filing} of this^{O.A. which has become T'A till the date of} realization.
