This Original Application is filed on 02.04.2019 by the applicant bank under Section 19 (1) of Recovery of Debts and Bankruptcy Act, 1993 (formerly Recovery of Debts Due to Banks and Financial Institutions Act, 1993) against the defendants jointly and severally for recovery of a total sum of Rs.23,07,96,983.32p (Rupees Twenty

Brief Facts of the case:

The Applicant submits that the application is filed within the period of limitation as prescribed under Section 24 of the Recovery of Debts and Bankruptcy Act, 1993, and the subject recovery claim falls within the jurisdiction of this Tribunal.

It is the case of the Applicant Bank that the First Defendant had applied for Cash Credit, LCBD and BG Facilities of Rs.350.00 Lakh and

It is submitted by the applicant bank that the First Defendant had executed Memorandum of Deposit of Title Deeds dated 17.05.2010 and registered as Document No. 3559 of 2010 to secure the enhanced facilities.

dated 16.03.2016 and further executed an Undertaking dated 16.03.2016 that the Second Defendant will not create charge/encumber any of her assets without prior approval of the Applicant Bank.

The Applicant Bank submits that the First Defendant had requested for the enhancement of LCBD facility to Rs.250.00 Lakh from Rs.150.00 Lakh and after due consideration of the request of the credit facility by the First Defendant, the Applicant Bank has enhanced the LCBD limit to Rs.25 lakh vide Sanction Letter dated 03.09.2016.

It is submitted that subsequent to availing of the aforesaid credit facilities, the defendants committed default in repayment. In view of the defaults committed by the Defendants, the Applicant Bank vide their Demand Notice dated 28.12.2017 demanded and called on the Defendants to discharge their entire liabilities within 15 days from the date of receipt of the notice by paying to the Applicant Bank a sum of Rs.20,04,62,617.03/-, outstanding as on 01.12.2017, with further interest from 02.12.2017 at the contractual rates upon the footing of compound interest, until payment and further advised that in case of failure to make payment, the Applicant Bank shall be constrained to take steps for enforcing the securities and realizing the dues. This Applicant submits that, in spite of the Applicant’s notices the First and Second Defendants did not make the entire payment as per the above said demand Notice. Hence the present Original Application (OA) has been filed by the applicant bank for recovery of its dues from the defendants.

After the filing of the OA, summons to D1 Served and D2 returned with the endorsement “Unclaimed”. Although, defendants entered appearance through their counsel and filed vakalat, did not choose to file written statement despite availing substantial number of adjournments. Hence opportunity to file written statement was closed on 07.10.2021. Subsequently also, there was no representation on behalf of defendants during any of the hearing dates. When OA was taken up on 24.03.2025 even after giving sufficient time, there was no appearance or representation from the defendants. Hence, defendants 1 and 2 were placed ex-parte on 24.03.2025.

Heard the submissions of Applicant Bank and perused the

To prove the case of the Applicant Bank, Mrs. Aparna R, Deputy General Manager representing the Applicant Bank, has filed her Affidavit by way of evidence and same was considered as evidence of AW-1 and list of documents came to be marked as Ex A-1 to A-158 . As the defendants remained ex-parte, the OA claim remains unchallenged. There is no contra evidence available on record to repudiate the claim of the Applicant Bank.

During the pendency of OA, Applicant Bank had reported part satisfaction of OA claim in a sum of Rs.1,71,20,000/- by way of sale of Item Nos. 1 and 2 of Schedule immovable property under SARFAESI Act. Accordingly, part satisfaction of sum of Rs.1,71,20,000/- is duly

With regard to the amount advanced, the interest applied, the conduct and operations in the account and the default committed, this Tribunal comes to the conclusion that the applicant bank is entitled for a final order on the following terms:
