Debts Recovery Tribunal directed cancellation of auction and allowed regularization by way of installment payments secured by father-in-law, subject to timely performance. Default invites resumption of proceedings.

He submits that they are ready to regularize this account and according to the Respondent FI, there are approximately an amount of Rs. 23.00 Lac due as on date.

It is submitted by Counsel for the Respondent FI that already account was regularized once and loan amount is also nearly Rs. 1.00 Crore, so they have their own doubts whether this account can be properly maintained by the borrower.

Be that it may be. Keeping in view the medical condition of the borrower and willingness of father in law to make the payment as an attorney holder for saving the property, it is ordered as under:-

An amount of Rs. 5.00 Lac be paid immediately. Amount of Rs. 6.00 Lac be paid by 10.07.2025 and another Rs. 6.00 Lac be paid by 10.08.2025 and another Rs. 6.00 Lac be paid by 10.09.2025.

Counsel for the Respondent FI will intimate the Counsel for the applicant the excess amount as on 30.06.2025 to be paid. Regular installments are due on 10^th of every month, applicant shall also pay the due EMI on 10^th . The amount so deposited shall be adjusted into the account and credited into the account of the borrower. Auction scheduled on 20.06.2025 stands cancelled. In case of any default, the respondent shall be at liberty to proceed from this point onwards.

In view of this SA stands disposed of with the liberty to all the parties to move application in case of any exigency. All pending IAs also stands disposed off, if any.

File be consigned to record as per rules. Copy of order be uploaded on website.
