This case is already fixed on 07.07.2025, but applicant has filed
I.A. for early hearing. As the matter is taken up for hearing so IA for early hearing stands disposed of as allowed, the earlier date fixed 07.07.2025 stands cancelled.
There is a settlement between the parties at the principal amount of Rs. 4.00 Lac and the bank want this payment to be made by 30.05.2025. However, the applicant seeks 15 days time to make the payment out of which Rs. 2.00 Lac will be deposited today or latest by tomorrow. Balance amount of Rs. 2.00 Lac be deposited within 15 days from today itself, i.e. by 06.06.2025. Let the applicant do so.
Counsel for the Respondent submits that they will not take any actions till the payment is being made.
It is made clear that if the applicant fails to deposit the above said amount, then the Bank will be at liberty to proceed ahead as per law.
In view of the above direction, this SA stands disposed off, all pending IAs also stands disposed off, if any.
