In this matter, the applicant has not challenged the auction, but requested for removal of assets which are lying in the property and bank has no objection.
Accordingly, Mr. Nirmal Verma, Advocate, Mob. No. 9602981204 is appointed as a Court Commissioner to visit the premises on and prepare the inventory of removal of articles/goods in the premises. SA Applicant and authorized officers of the respondent bank are directed to present at that time. The applicant shall intimate date and time for removal of the goods to the counsel for the bank who will intimate to the Court Commissioner.
The fees of the Court Commissioner shall be borne by the Respondent bank which is fixed at Rs.5,000/- (Rupees Five Thousand only) beside travelling and out of pocket expenses.
The report of the Court Commissioner be placed on record within one week of visit. Copy of the report shall also be given to the applicant and also to the opposite counsel . The Police Authorities of the concerned area are hereby ordered to provide police protection if required to the Court Commissioner.
In view of the above directions, this Securitization Application stands disposed of.
