In this matter, there is an issue regarding limitation and counsel for the applicant submits that the applicant no. 1 was out of India when those proceedings took place and his wife not received the summons.

As per orders of District Collector, Baswara, the summons were issued and they were duly accepted by the applicants herein.

In these circumstances, there is no limitation in this matter as they have chosen to remain absent otherwise they would have come to know the DM order. Total outstanding amount is Rs. 11.00 Lac. In case, the applicant approaches the bank with down payment of Rs. 2.00 Lac with settlement proposal, the respondent bank may consider it as per their policy and grant certain concessions to them as per their policies.

In view of the above submissions, I.A no. 206/2024 for condonation of delay under Section 5 stands dismissed so, this Securitization Application is also dismissed. However, this will not preclude them from challenging further actions taken by the respondent bank.

Copy of the order be given Dasti to the concerned parties. File be consigned to record, as per rules.
