In this matter, the discrepancy has been pointed out in the affidavit filed before the District Magistrate, though it is stated that the affidavit sworn in by Yash Suri. However, counsel submits that in the end the name of Maan Singh Meena has come inadvertently. The document is on oath ten how can the same be not seen. Definitely, oath is not by Yash Suri when name of Maan Singh Meena is mentioned.
This is the height of action of cut and paste and negligent the attitude of the officer while executing documents. This is a fit case where these proceedings under Section 14 should be set aside for the discrepancy stated above. Therefore, the same is set aside. Bank will be at liberty to proceed afresh and SA stands disposed of as allowed to above extent.
Accordingly, SA stands disposed off, all pending IAs also stands disposed off, if any.
