In this matter, counsel for the applicant argued that the bank has sold the property in auction without issuing Rule 8(6) Notice. Counsel for the bank submits that they have settled the account with the borrower.
The applicant insisting that the sale deed on the basis of which the property was mortgaged is under challenged in civil suit as no payment were received, for that an F.I.R. is also being lodged. Be that it may be, the bank received their entire money and no auction has ever taken place.
The grievance of the applicant against the borrower/ purchaser, the property will be remained unaffected by disposal of the SA.
In view of the circumstances, this Securitization Application stands disposed of.
