This memo is filed by the learned counsel for the respondent bank stating that the bank wishes to withdraw the demand notice dated 15.06.2015 with liber"ty to initiate proceedings afresh and therefore SA has become infructuous and accordingly liable to be dismissed. 4,:

In his fttions memo, learned counsel for the applicant subrkits that it is just and necessary to direct the bank not to charge costs associated with issuance of notices and to compensate the litigation costs.
