Makhija, Mrs. Kamlesh Makhija, Mrs. Jamna Devi, Mr. Satish Chandra Makhija, Mr. Naresh Makhija, Mr. Nikhil Makhija and Mr. Nitish Makhija, however, the Respondent No.2 Bank issued a Notice under Section 13 (2) of the SARFAESI Act, 2002 dated 30.11.2022 to M/s Mahadurga Charitable Trust, Mr. Ashok Makhija, Mr. Satish Chandra Makhija, Mr. Naresh Makhija, Mr. Nikhil Makhija and hence it is clear that Respondent No.2 Bank has not issued a Notice under Section 13 (2) of the SARFAESI Act, 2002 to Mrs. Kamlesh Makhija, Mrs. Jamna Devi and Mr. Nitish Makhija and accordingly the Respondent Banks have not served the Notice to all the borrowers and guarantors, therefore, the Respondent Banks cannot proceed with the Auction dated 29.10.2024 and any subsequent action under the SARFAESI Act, 2002 and the Non-Service of the Demand Notice issued under Section13 (2) of the SARFAESI Act, 2002 under the SARFAESI Act, 2002 is the Gross violation of the Act and various judgements laid down by the Apex Court and even it would be pertinent to note that the Demand Notices issued by the Respondent No.1 and the Respondent No.2 were never served upon the Trustees of the Applicant No.1, however, for reasons best known to the Respondent No.1 Bank, the Sale Notices were being served upon the Trustees of the Applicant No.1. It has further been submitted that in response to the Notice issued by the Respondent No.2 Bank under Section 13 (2) of the SARFAESI Act, 2002, detailed objections were raised
