B. The basic grievance of the applicants in the SA isthat the respondent company has not issued anyprior notice before issuance of possession notice dated 03.1L.2022. To counterthe allegation, respondent companyplaced onrecord Photostat copies of demand notice,postal receipts,postal trackreport, publication of demand notice in The Financial Express and Andhra Prabha vide materialpapers atpages from 29 to 33 annexed to the reply statement. Hence the allegation over violation of Section 13(2) of the SARFAESI Act is notproved. Similarly, respondent filedproof of servingpossessionnotice vide material papers atpages from 35 to 39 annexed to the reply statement. It is not the case of the applicants that they were regular in repayment of loan amount. Applicants have not disputed bouncing of cheque issued by them towards the EMI of the loan amount. Under these facts and circumstances, the secured credit is entitled to take steps uls 14 of the SARFAESI Act for taking physical possession of the secured asset.
