equitably mortgaged House measuring 500 sq. yards situated at House No. 129, NRI Enclave (Carlton Woods) Phase-II, Village Jhammat, Shaheed Sukhdev Nagar, South City, Tehsil and District Ludhiana owned by him; that loan accounts of applicant were running irregular since long and applicant failed to maintain the financial discipline of the bank and did not adhere to the terms and conditions of loan documents and sanction letter; that respondent had repeatedly requested the applicant vide letters dated 07.11.2019, 29.11.2019, 12.12.2019, 22.01.2020 and 05.02.2020 that Adhoc Facility was expired on 27.11.2019 and inform the applicant to clear the entire dues of the said facility; that respondent vide several letters inform the applicant to submit the required documents for renewal of the limit, pay the outstanding dues, route the entire business transactions through the loan account as there is no transaction regarding the business since February, 2020; that thereafter, meeting was held on 29.01.2020 and 25.02.2020 at the Regional Office of the respondent, which was attended by Bank Officials and Sh. Arjun Sethi and it was informed that the account is running overdue, renewal is also pending since long due to which account is likely to be slip into NPA and further Adhoc Limit of Rs.02 Crores has not been adjusted; that Sh. Arjun Sethi has submitted that he is shifting his loan account to the UCO Bank; that respondent vide letter dated 20.03.2020 has been informed the applicant that the applicant has not provided any information to the Auditor for the stock audit as per RBI Guidelines and further requested the applicant to provide the documents to the auditor immediately but the applicant failed to submit the documents; that thereafter also several mails and on several dates respondent requested to applicant for providing the documents but applicant has not complied with; that applicant has also not adjusted the Adhoc limit of Rs.02 Crores, which remained overdue for more than 90 days; that technically, it was an NPA accounts since 23.02.2020; that loan accounts of the applicant was not declared as NPA due to the Government Guidelines on moratorium period which was granted upto 31.08.2020; that later on, Hon’ble Supreme Court has also issued directions that no account shall be declared as NPA till further orders, which were not declared as NPA till 31.08.2020; that therefore, the loan accounts of
