objection was raised at that point of time. Due to default in repayment, the account was classified as NPA and SARFAESI action was initiated against borrower and guarantor. Accordingly, Demand Notice dated 17.01.2022 was issued and served to the applicants as also admitted in its application. No representation against demand notice was received to the bank. Hence, reply/disposal of alleged representation does not arise. Further, the respondent bank in accordance with the Act and Rules, approached the District Magistrate for physical possession of the property. The District Magistrate passed an order dated 26.07.2022 vide which date of physical possession was fixed on 08.08.2022. Accordingly, the respondent bank took the physical possession of the property on 08.08.2022 with the help of District Administration and also affixed the possession notice on secured asset. .Inventory and Panchnama were prepared in the presence of the son of applicants and other persons. The respondent bank tried to hand the copy of said inventory & Panchnama to the son of the applicants but he refused to receive the same. Hence, the respondent bank served the copy of Inventory alongwith Possession Notice to the applicants through post on 12.08.2022. There is no provision to serve the notice issued u/s 14 of the Act to the applicants. The Possession Notice was also published in newspapers.
