received the said notice as evidenced by his signature on the office copy of the said demand notice. Copy of the said demand notice filed by the lst Respondent contains the signature of Respondent No.3. Aas the said notice was not served on some of the Respondents, the lst Respondent published the said notice in Telugu and English daily newspapers as evidenced by the copies of paper publication filed by the bank. The said notice was also aflixed on the schedule property as depicted in the copies of photographs filed by the Bank. Thus there is valid service of demand notice on the Applicant and Respondents No.2 to 5. After issuing demand notice, the l"t Respondent issued possession notice dt. 13.06.2022 and the said notice was affixed on the schedule property as depicted in the photographs liled by the Bank and the same was published in Telugu and English daily newspapers as evidenced by the copies of paper publication filed by the Bank. In fact, the Applicant received the said notice as evidenced by his signature on the office copy of the said notice filed by the 1st Respondent Bank. Thus there is valid service of possession notice on the Applicant and others. So far as the sale notice is concerned, according to the lst Respondent bank, sale was materialized in pursuance of the 4th sale notice dt.17.O5.2O23 issued by the Bank. The lst Respondent filed documents to prove that on earlier occasions, the 1"t Respondent bank issued sale notices to the Applicant and others. But no document is Iiled by the Bank for establishing that prior to issuance of sale notice, the Bank has issued pre-sale notice u/r 8(6) of Rules, 2OO2 to the Applicant for giving an opportunity to redeem the schedule property. It appears that without issuing any pre-sale notice, the bank straightaway issued sale notice dt. 17.O5.2023.
