Present: Sh. Puru Gupta, Counsel for the Applicant. Sh.Himanshu Sharma, Counsel for the respondent bank.
Mr.Sharma, counsel for the respondent bank has made a statement at the Bar that due some miscommunication bank did not dispose of the objections filed by the applicant under Section 13(3A) of the SARFAESI Act. He further states that the bank has taken a decision to withdraw the SARFAESI action after the notice under Section 13(2) and bank would dispose of the objections filed by the applicant within 15 days. However, Mr.Gupta states that applicant has been unnecessarily burdened with the court fees and other charges in this case.
In view of this, the present SA stands disposed of with the observations that the bank would credit the account of the applicant with Rs.8,000/- as court fees.
File be consigned to the record room after due compliance.
