In this matter, the SA is not within limitation. Counsel for the respondent FI submits that notices were got received by hand and the SA has not been filed within limitation. There is not any application filed for condonation of delay. She further submits that the SA was filed challenging the auction which has not taken place, therefore this SA may become infractuous and it may be disposed of accordingly.
At this juncture, Counsel for the applicant submits that the bank has obtained the order of CJM. The applicant is at liberty to challenge such order.
Accordingly, SA stands disposed off, all pending IAs also stands disposed off, if any.
