said Flat had not been sanctioned by MC, Solan. She also came to know that the borrower had also filed an SA in Debts Recovery Tribunal. On coming to know of this fact, vide letter dated 17.02.2025 (Annexure A-4), she requested the Bank to refund her 25% of the amount deposited by her to this auction. However, the Bank did not respond to the same. Again, vide letter dated 25.02.2025 (Annexure A-5), she made a request to the Bank to refund the money. However, again the Bank did not respond to the same. On 16.03.2025 (Annexure A-6), she again made a request to the Bank for refund of money. She also offered that in case the Bank was ready to issue the sale certificate, she would deposit the remaining 75% from her own resources. However, again Bank did not respond to the same. She also wrote a letter to the Bank that in case the Bank would be able to deliver a clear title, she would deposit the money. However, again Bank did not respond to the same. She is a school teacher. She further alleged that in the publication notice, Bank did not mention that already an SA was pending in respect of the same property in the Debts Recovery Tribunal. On these facts, Applicant filed the present SA with the request to refund her the auction money deposited by her, alongwith interest @ 14% from the date of deposit. It is further prayed that in the alternative that in case the Bank is ready to pass a clear title to her, in respect of the property, she would make the payment within 30 days. Alongwith SA, Applicant also filed an application for condonation of delay, if any.
