In this case, respondent bank has withdrawn the SARFAESI action. Counsel for the applicant states that applicant has been unnecessarily burdened with the court fees of Rs. 22,000/- and the bank be directed to refund the same.
Counsel for the parties agree that the bank would credit the loan account of the applicant with 50% of the court fee deposited by the applicant i.e. Rs. 11,000/-. The necessary credit be given within 15 days from today. In view of this, the present SA stands disposed of.
File be consigned to the record room after due compliance.
