The parties to the case i.e. the Applicant and the Defendant Bank have entered into compromise as follows:-

That at the request of the Applicant the Defendant Bank has agreed to accept Rs.

25.00 lakhs (Rupees Twenty Five Lakhs only) in full and final satisfaction of the

entire claim amount.

The aforesaid settlement of Rs. 25.00 lakhs will be paid in the following manner. LA~

HDFC Bank) as upfront amount directly to the Bank.

b) Balance amount payable from the date of filing of this Joint Compromise petition

In case of non-payment of the instalment amount on its due date, as per the settlement, the award of the Lok Adalat shall be treated as "Recovery Certificate" and directly recovery proceeding shall be initiated by the Defendant bank for the recovery of original claim amount i.e. Rs. 9,22,033.18, along with interest thereon from dated 01.10.2016 without referring the matter before the bench of

Debts Recovery Tribunal for adjudication of the claim amount.

Till the payment of the entire settlement amount is made there shall be charge over -the hypothecated and mortgaged properties of the principal borrower, guarantor & mortgagor as well as over the other properties of the borrower and the borrower shall not alienate, transfer 9r dispose of any of their properties.

That the Bank's claim as to the subject matter will remain unaffected and survive against the defendants who are not parties to the Compromise. However the Bank agrees that if the payment is made in terms of the compromise and no default. -is committed,· the bank _will not proceed against the defendants who are not the parties to the compromise. Accordingly the other d~fendants will also stand discharged from the liabilities on receipt of full settled amount and the recovery proceedings shall be closed.
