The Applicant Bank filed the present OA for the recovery a total sum of Rs.50,95,905.86ps towards Loan A/c. Nos.g4OO4529, 693201-2, 8132090, 0001014490002537509 & 0001019010009985017 from the defendants joinuy and severally with future interest @8,85o/o, 1g.30% & 8.25olo p.a. along with interest @ 2o/o p.m. from the date of application Ull the date of realization along with costs and in default for sale of OA schedule property.

Summons served on D1, whereas summons served on D2 and 3 through paper publication. They were set ex_parte on 70.07.2023 as called absent and no representation.

The Applicant Bank examined Nikhila Y, Legal N4anager, as AW1 and marked 04 documents through her as Ex. A.1 to Ex. A.O4 and examined Adithya A S, Legal lvlanager, as AW-2 and marked 05 documents through her as Ex. A.5 to Ex. A.09.

The point that arises for consideration is:-

Whether the Applicant Bank is enti ed for the claim made in the OA against the Defendants and OA schedule property?

As stated supra, the Defendants remained ex_parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A.09 marked on behalf of the Applicant Bank clinches the claim of the Applicant '"t Bank aqaiDst^u"'o the Defendanti

Hence, I hold that the Defendants are jointly and severally liable to pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Application No.97712022 is allowed as under:^-

i) The Defendants are jointly and severally liable to pay to the Applicant Bank a sum of Rs.50,95,905.86ps towards Loan A/c. Nos. 84004s29, 69320t2, 8132090, 0001014490002537509 & 0001019010009985017; with future interest @8.600/o^p.a. simple from the date of application till the date of realization;

ii) the OA claim is secured by way of mortgage of property described in the schedule annexed to the OA and the applicant bank is entitled to proceed against the same to realise its debt;

iii) the applicant bank is also entitled to proceed against the person and properties of defendants for reallzation of its dues;

iv) the applicant bank is entitled for the costs.

L The Applicant Bank is directed to file Cost Memo within 2 weeks from the date of receipt of this Order.
