This Original Application has been filed under S.19(1) of the Recovery of Debts and Bankruptcy Act, 1993 for recovery of an aggregate sum of Rs.15,84,98,994.51 due under various loan accounts together with future interest and costs from the defendants and by sale of ‘A’ to ‘K’ schedule properties.

Facts of the case:

The applicant is a banking company registered under

the Companies Act, having its registered office at Aluva and a branch amongst other places at Kottarakkara, Kollam District.

The 1^st defendant is carrying on business in the name and style of ‘M/s.Peniel Cashew Company’. Considering the request of the defendants, applicant bank sanctioned various credit facilities viz., packing credit loan, GECL, cash credit, FKCC loan etc. and the said facilities were renewed/enhanced from time to time. The defendants availed the loans after executing necessary loaning/security documents in favour of the bank. Towards collateral security for the loans, the defendants and one G.Oommen, father of the 1^st defendant, created equitable mortgage over the OA schedule properties by deposit of respective title deeds with the applicant. It is submitted that after

the death of G.Oommen, the property described in ‘G’ schedule devolved on the 1^st defendant as per Will No.6/2001 dated 22.01.2001 of Kottarakkara Additional SRO. After availing the loans, the defendants did not adhere to the repayment schedule and the accounts turned NPA. Despite recall notices including the demand notice under S.13(2) of the SARFAESI Act were issued to the defendants, they did not turn up to liquidate the liability. In such premises, the applicant bank was constrained to file the OA claiming the following reliefs:

(i) To recover an aggregate sum of Rs.15,84,98,994.51 together with pendente lite and post decree interest from the defendants and by sale of ‘A’ to ‘K’ schedule properties;

(ii) To recover the costs, charges and expenses from the defendants;

(iii) To issue Recovery Certificate to the Recovery Officer with a direction to recover the amount and pay it to the applicant bank.

The defendants entered appearance and sought

adjournment for filing written statement but they did not file the same despite sufficient opportunity being granted. During the

hearing, the learned counsel appearing for the defendants orally disputed the claim made by the applicant bank.

Proof Affidavit :

In order to establish the claim on behalf of the applicant bank, one Mrs.Anitha G., Deputy Vice President and Branch Head has filed proof affidavit and produced the loan documents marked as Exhibits A1 to A168. The proof affidavit filed by AW1 and the documents produced in this case are not challenged by the defendants. The availing of the loans and creation of mortgage over ‘A’ to ‘K’ schedule properties are well established from the documents placed by the applicant bank. An aggregate sum of Rs.15,84,98,994.51 is outstanding in the loan accounts as on 12.12.2023, which is clearly established from the accounts statements marked as Exts.A158, A159, A161 and A163.

As per the materials available on record, defendants 1 and 2 are liable to pay the amount due under the FKCC loan account and not from the 2^nd defendant alone as claimed by the applicant bank and also ‘K’ schedule property alone is secured to the said loan transaction.

Considering the amount advanced, interest and penal interest applied, repayments effected and default committed, I am of the view that the applicant bank is entitled to get pendente lite and post-decree interest in the manner stated below, which is reasonable in the facts and circumstances of the case.

The applicant bank, therefore, is entitled to get a final order on the following lines:

In the result, the applicant bank is given a final order allowing it to recover:

Packing credit loan account	Rs.4,10,40,874.50 (Rupees four crores ten lakhs forty thousand eight hundred and seventy four and Paise fifty only) together with_pendente lite_and post decree interest thereon @9.80% per annum from

	and severally and by sale of ‘A’ to ‘J' schedule
	properties;
GECL account	Rs.2,92,00,305.27 (Rupees two crores ninety two lakhs three hundred and five and Paise twenty seven only) together with_pendente lite_and post decree interest @9.25% per annum on the sum of
	Rs.2,82,51,632.05 (Rupees two crores eighty two lakhs fifty one thousand six hundred and thirty two and Paise five only) from 29.12.2023 till realisation from the defendants jointly and severally and by sale of ‘A’ to ‘J' schedule properties;

Cash credit account	Rs.8,30,10,151.44 (Rupees eight crores thirty lakhs ten thousand one hundred and fifty one and Paise forty four only) together with_pendente lite_and post decree interest @8.75% per annum on the sum of Rs.7,70,97,244.31 (Rupees seven crores seventy lakhs ninety seven thousand two hundred forty four and Paise thirty one only) from 29.12.2023 till realisation from the defendants jointly and severally and by sale of ‘A’ to ‘J' schedule properties;
Federal kisan credit card account	Rs.52,47,663.30 (Rupees fifty two lakhs forty seven thousand six hundred and sixty three and Paise thirty only) together with_pendente lite_and post decree interest @6% per annum on the sum of
	Rs.51,18,682.64 (Rupees fifty one lakhs eighteen thousand six hundred and eighty two and Paise sixty four only) from 29.12.2023 till realisation from the defendants jointly and severally and by sale of ‘K’ schedule property; and
also cost from the	s and expenses borne by it for realisation of the loans defendants.

9. ‘A’ to ‘K’ schedules to the OA shall be appended to

The applicant bank shall file memo of costs within ten days from the date of this final order.

Recovery Certificate shall be drawn up and issued to the Recovery Officer in terms of the final order.
