The Applicant Bank filed the present OA against Defendants for recovery of a total sum oF Rs.46,81,315.15ps (Rupees Forty Six Lakhs Eighty one Thousand Three Hundred Fifteen and paise fifteen only) along with interest @ 12.30% p.a plus 2.007op.a penal interest from 31.12.2024 till the date of realization.

As per the averments in the application, the Applicant Bank states that defendant no.1 availed term loan of Rs.54.96 lakhs for purchasing two brand new Hamm made vibratory soil compactors vide loan application dated 10.02.2023. Defendants 2 & 3 stood as guarantors and executed guarantee agreement dated 06.04.2023. After availing the loan facility, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NPA on 29.L0.2024 and legal notice was issued on 30.72.2024. Inspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.

Defendants called absent and set exparte on 13.08.2025.

The^point that arise for consideration^{is whether the ApplicantBank is} entitled for the claim made in the OA^{against the Defendantsas} prayed for?

Defendants remained exparte. To substantiate^{the case of the} Applicant Bank, AW.1, official of^{the Applicant Bankwas examinedand} he exhibited relevant documents as^{Ex.A1 to 4.6.In view of the} above, I hold that the Applicant^{Bank has establishedtheir claim made} in the OA against the Defendants and^{hence the Applicant Bank is} entitled to recover the claim^{made in the OA with future interest and} costs.

In the result, the^present OA^is allowed^{with costs, as under:} The Defendants are^jointly and^{severally liable to pay to the Applicant} Bank a total sum of Rs.46,81,315.15ps^{(RupeesForty Six Lakhs} Eighty one Thousand Three^{Hundred Fifteenand paise fifteen} only) along with interest @^{12.30o/op,a from 31.12.2024 till the date} of realization.
