Matter is taken through Video Conferencing/Hybrid mode.
The Ld. Counsel for the applicant bank submitted that he has filed affidavit vide dy. no.79L512025 dated 06.08.2025 for satisfaction affidavit of AR qua settlement.
It is submitted that during pendency of thepresent OA proceedings, a settlement was arrived between the Applicant and the Defendants on 26.05.2025 for an OTS amount of Rs.12,00,000/- only as full & finalpayment for closing loan in question bearing No. 350040935360019. In terms of the said settlement, the applicant bank has received the entire settlement amount from the defendants, and nothing remainspayable from defendants' side. Copies of Settlernent Ietter dated 26.05.2025 & Letter handing over DD of Rs. L2 Lakhs by the defendant Company are being filed with thepresent application as Annexure-A. In view of the settlement with defendants' the applicant bank doesn't want topursue and continue thepresent OA proceedings. As such, the applicant bank wants to withdraw the present OA.
In view of the above submission made by the Ld. Counsel for applicant bank, OAlB79l2024 is dismissed as withdrawn.
