IA no.152912025 has been filed by the applicant bank for withdrawal of the^present OA.

The Ld. Counsel for the applicant bank submits that the^mafter has been settled and the loan account of the defendants^has been closed accordingly. Therefore, the applicant bank^seeks permission of this Honble Tribunal to withdraw the^present Original Application, as settled.

The !-d. Counsel of the applicant has also rcquested^for refund of the court fees. It is submitted that the^matterhas been settled and therefore, the court fees^{may be refunded as} per provisions contained in the rules. In this regard the Honble Supreme Court has^passed the order in^{SLP(c) No(s).723/2023} datd 28.01.2025 titld as Jage Ram^Vs Vd^{l@ur & Orc. The} Honble Supreme Couft has considered^{the mafter and has held} that:

Para 6- The refund of court fes^{is permissibleonly} it the matter is referrd to Arbitration,^{Conciliation,} judicial ttlement, including through Lok Adalat or mdiation for settlement and the cas^is diddⁱⁿ terms of such a ettlement^{and not otherwis.}

Para 7- In the ax at hand,^{the setflementin terms} of which the wond appeal^was duidd^{by the High} Coutt is not on reference to any of^{the above} authoritis/fora rather it^{was an} amiable^sttlement out of the court.

Para 8- Accordingly, we are of^{the opinion that the} petitioner is not entitld to refund of the court fes and the High Court has not committd^{any enor or} illqality in refusing such a^prayer."

In view of the above, it is clear that^{if the matterhas been} settled out of the court without any^{referencefrom the court or} Tribunal, the court fees cannot be refunded.^{Therefore,the} prayer of the applicant for refund of court fees is^hereby declined. 'S>
