Summon sent to sole defendant returned with endorsement unclaimed, hence deemed to be served and was set ex_parte on 09.10.2025 as called absent and no representation.

The Applicant Bank examined Vijendla Anvesh, Legal Manager as AW-1 and marked 0B documents through him as Ex. A.1to Ex. A.g.

Heard the Ld. Counsel for the Applicant Bank and perused the material placed on record.

The point that arises for consideration is:_

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendant?

As stated supra, the Defendant remained ex_parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A.0B marked on beharf of the Appricant Bank crinches the craim of the Applicant Bank against the Defendant. Hence, I hold that the Defendant is liable to pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Application No.B03/2025 is allowed as under: -

i) The Defendant is liable to pay to the Appticant Bank a sum of Rs.20,97,763l_ as on 07.0g.2025 towards Xpress Credit Loan A/c,No.4L2465g6930 with future interest @1L.g0o/o p.a. simple, from the date of apptication till the date of reatization;furvg

ii) the applicant bank is also entifled to proceed against the person and properties of the defendant for

realization of its dues;

iii) the applicant bank is entifled for the costs.

Issue Recovery Certificate accordingly.
