Agriculture Overdraft (AGOD) Limit of Rs.10.00 Lacs vide Loan Application dated 13.11.2014, which are Annexures A2 & A3 to this OA. 3. The applicant sanctioned KCC Limit of Rs.15.00 Lacs and Agriculture Overdraft (AGOD) Limit of Rs.10.00 Lacs vide Sanction Letter dated 20.11.2014, which are Annexures A4 & A5 to this OA. 4. Defendant no.1 mortgaged his immovable properties i.e. land measuring 46K-03M situated in Village Hambran, H.B. No.2J, Tehsil Jagraon, District Ludhiana vide Declaration under Section 4(1), which is Annexure A12 to this OA. Documents executed:- D.P. Notes, Hypothecation Cum Loan Agreement, Composite Documents, Letters of Declaration & Assurance, Letters of Declarations, Undertakings and Authorities, Agreements of Guarantee all dated 20.11.2014, which are Annexures A6 to A11 & A13 to A18 to this OA; Letters of Acknowledgement of debts and securities dated 17.11.2020, which are Annexures A19 to A22 to this OA; Legal Notice along with postal receipts dated 10.02.2023, which are Annexures A23 to A25 to this OA and Statements of Accounts along with Certificate, which are Annexures A26 & A27 to this OA. 5. The loan accounts became irregular and were classified as NPA and after adjusting debit and credit entries in both loan accounts there was adebit of Rs.44,53,718.00, which is recoverable and the defendants were served recall notices but they did not repay the outstanding amount, therefore, the applicant requested to accept the application and to issue Recovery Certificate accordingly. 6. The defendants were served notices to appear before this Tribunal but no one appeared on behalf of defendants and they were proceeded ex-parte on 05.02.2025. 7. In support of the OA, affidavit of Mrs. Amandeep Kaur, Chief Manager, Bank of India h as been filed.
