The Applicant Bank filed the^present OA for the recovery of a total sum of Rs.1,11,38,799/- i.e., a sum of Rs.33,15,186/- towards Overdraft Loan with future interest @13%^p.a., a sum of Rs.46,34,121/- towards ECLGS Loan with future interest @9.50o/o p.a. and a sum of Rs.31,89,4921- towards ECLGS (Extension) Loan with future interest @9.50o/o p.a. from the defendants^jointly and severally with monthly rests from the date of application till the date of realisation along with costs.

Summons served on D1 to 4 through^{paper publication.} They were set ex-parte on 13.10.2025 as called absent and no representation.

The Applicant Bank examined Gopi Krishnan, Legal Manager as AW1 and marked 17 documents through him as Ex. A.1 to Ex. A.17.

Heard the Ld. Counsel for the Applicant Bank. Perused the material placed on record.

The point that arises for conslderation is:-

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendants?

As stated supra. the Defendants remained ex-parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A.17 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants.^Hence, I^hold that^the Defendants are^jointly and severally liable to^pay the OA^{claim to} the Applicant Bank with future rLur E, interest rEr EsL """'"."t!/a6*land cosgd\ryy

In the result, the present Original Application No.5g6/2025 allowed as under: -

i) The Defendants are joinfly and severally liable to pay to the Applicant Bank a sum of Rs.1,11,39,199/_ i.e., a sum of Rs.33,15,186/- towards Overdraft Loan, a sum of Rs.46,34,12U- towards ECLGS Loan and a sum of Rs.31,89,492l- towards ECLGS (Extension) Loan; with future interest @9.50o/o p.a. simple, from the date of application till the date of realization;

ii) the applicant bank is also entitled to proceed against the person and properties of the defendant for realization of its dues;

iii) the applicant bank is entitled for the costs.

B. The Applicant Bank is directed to file Cost Memo within 2 weeks from the date of receipt of this Order.

Issue Recovery Certificate accordingly.
