ORDER
I, allow this OA and direct the defendants to pay to the applicant bank, jointly or severally, within a period of 30 days, a sum of Rs.35,89,827.83 (Rupees Thirty Five Lacs Eighty Nine Thousand Eight Hundred Twenty Seven and paisa Eighty Three only) as on 19.06.2024 along with pendentelite and future interest @10.10% per annum with monthly rests and costs from 20.06.2024 till the date of realization and costs, failing which, the same shall be recovered from the sale of mortgaged property i.e. Arazi No.971, Mauza Goithan, Shivpur, Banaras, Varanasi measuring 736 sq.ft. In case of shortfall, the same shall be recovered from other movable and immovable properties of the defendants.
(II) The recovery certificate be issued forthwith and be sent the Recovery Officer, Debt Recovery Tribunal-I, Delhi.
(III) Parties are directed to appear before Recovery Officer, DRT I, Delhi on 18.02.2026.
(IV) Copies of final order as well as Recovery Certificate be sent to all concerned free of cost.
