Defendant is a Proprietary concern engaged in the business of Sweet and Dairy products under the name and style as “M/s Torana Sweet Home and Dairy Farm”. Defendant had approached to the applicant bank through its Director on 04.02.2019 for grant of Term Loan of Rs.15,00,000/- and Cash Credit Facility of Rs.15,00,000/-, for business requirements. Applicant Bank had considered the proposal

of the defendant and sanctioned Term Loan of Rs.15,00,000/- and Cash Credit Facility of Rs.15,00,000/- on 25.02.2019 to the defendant on certain terms and conditions as set out in Original Application.
Defendant has executed certain loan and security documents in favor of the Applicant Bank at the time of availing Term Loan and Cash Credit Facility of Rs.15,00,000/- each as set out in Para No.5.6 of the Original Application. So also, the defendant has executed Hypothecation cum Loan Agreements dated 25.02.2019 and 20.03.2019.

spite of repeated requests by the applicant bank. Consequently, the loan accounts became NPA on 31.03.2021. Thereafter, the Applicant Bank through its Advocate Smt. Tejashri Y. Hirve had issued Loan Recall Notice dated 28.08.2021 to the Defendant calling upon to pay the outstanding amount of Rs.35,90,336.27Ps within 8 days from the date of receipt of the said notice. Despite service of the Notice, the defendant failed and neglected to comply with the due demand in the said Loan Recall Notice.
