Summon sent to D1 and D2 through paper publication. They were set ex-parte on 23.09.2025 as called absent and no representation.

The Applicant Bank examined tyr. Manish Kumar Madhukar Bansod, Asst. General Manager as AW_1 and marked 20 documents through him as Ex. A.1 to Ex. A.20.

Heard the learned counsel for the Applicant Bank. perused the material placed on record.

The point that arises for consideration is:-

Whether the Applicant Bank is enti ed for the claim made in the Oe against the Defendants and OA Schedule piperty?

As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A'20 marked on beharf of the Appricant Bank crinches the craim of the Applicant Bank against the Defendants. Hence, I hotd that the Defendants are joinfly and severaly riabre to pay the oA craim to the Applicant Bank with future interest and costs.

In the result, the present O rriginal Application No 534/2024 is

alowed as under: -

i) The Defendants are joinUy and severally liable to pay to the Applicant Bank a sum of Rs.8O,5O,9g4l_ with future

ii) the OA claim is secured by way of mortgaged property described in the schedule annexed to the OA and the applicant bank is entiued to proceed against the same to realise the debt:

the person and properties of the defendants for realization of its dues;

iv) the applicant bank is entiUed for the costs.
