The Appricant Bank fired the present oA for the recovery of a sum of Rs.35,64,2r9.28ps from the defendants joinfly and severaily with future interest @1go/o p.a. compounded with monthly rests from 08.08.2024 till the date of realisation along with costs.

Summons served on D2 to 5 through paper publication. They were set ex-parte on 09.04.2025 as cared absent and no representation. ws of D1 not fired hence, right was forfeited on 27.06.2025 as called absent and no representation. DE of D1 not filed hence, right was forfeited and was set ex-parte on 07.11.2025 as called absent and no representation.

The Applicant Bank examined Sai pavan Gudivada, Legal Manager as AW-1 and marked 09 documents through him as Ex. A.1 to Ex. A.09. 9K'^\t'7

Heard the Ld. Counsel for the Applicant Bank. Perused the material

The point that arises for consideration is:-

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendants?

As stated supra, the Defendants remained ex-parte. The Evidence

, Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A.09 marked on behalf of the Applicant Bank cllnches the claim of the Applicant Bank against the Defendants. Hence, I hold that the Defendants are^jointly and severally liable to pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Application No.440/2024 is allowed as under: -

i) The Defendants are^jointly and severally liable to pay to the Applicant Bank a sum of Rs.35,64,279.28ps with future interest @9.260lo p.a. simple, from the date of application till the date of realization;

il) the appllcant bank is also entitled to proceed against the person and properties of the defendant for realization of its d ues;

iii) the applicant bank is entitled for the costs.
