This original application has been filed by the applicant bank on 28.06.2024 through Ms. Nitya Bakshi, authorized representative of the applicant bank under Section 19 of Recovery of Debts Due and Bankruptcy Act, 1993 against the defendants for recovery of a sum of Rs.39,91,817.36 (Rupees Thirty Nine Lacs Ninety One Thousand Eight Hundred Seventeen and paisa Thirty Six only) as on 01.06.2024 along with pendentelite and future interest @9.86% per annum with monthly rests from 01.06.2024 till the date of realization and costs.

The brief facts of the case are that at the request of defendant no.1 being proprietor of M/s S.G.Plastics, the applicant bank sanctioned two commercial vehicle loans for a sum of Rs.21,64,648/- each on 26.04.2023 @9.86% interest per annum to be repayable in 59 EMIs of Rs.46,448/- each in order to purchase TATA 1412 HD BSVI light commercial vehicles against hypothecation of vehicles. The defendant no.2 stood as guarantor for the vehicle loan facility availed by defendant no.1 by the applicant bank.

That in order to avail the light commercial vehicles loan facilities, the defendant no.1 as proprietor of M/s S.G.Plastics

submitted loan application and executed Loan Agreements along with hypothecation deed of vehicles and defendant no.2 executed Guarantee Agreement for the loans availed on 26.04.2023.

That in order to avail the light commercial loan facilities, the defendant no.1 as proprietor hypothecated the light Commercial vehicles namely TATA 1412HD BS VI having Registration no.DL1GE2428 & DL1GE2313, Chassis number MAT767257N5H10885 & .MAT767257N5H10883 Engine number 3.8SG181GXX813304 & 3.8SG18GXX813099 in favour of applicant bank on 26.04.2023.

It has been submitted by the applicant bank that after availing the aforesaid loan facilities, the defendants failed to adhere to the repayment schedules and to comply with the terms and conditions despite of several requests and reminders. The defendants failed to pay monthly installments which became overdue to the applicant bank. Ultimately, the applicant bank issued legal notice dated 18.06.2024 recalling the loan facilities and to repay the entire dues with interest, but defendants failed to so. Hence, the applicant bank has approached this Tribunal for recovery of their dues.

Notices of this O.A. were issued to the defendants and despite of proper service the defendants have chosen to absent from the proceedings. As per order dated 25.09.2025, the defendants have been proceeded ex-parte as they have not appeared before the Tribunal and even no written statement, evidence and affidavit of assets has been filed on behalf of the defendants.

In order to prove its case, the applicant bank has filed various documents such as Board Resolution, Loan

application, PAN card, Aadhar card, Terms and Conditions with Schedule, Original Disbursement voucher, Statement of account, Foreclosure report, Demand notice, Certificate under Section 65B of Indian Evidence Act and Certificate under Section 2A of Banker's Books Evidence Act marked as Annexure Al to A-14 from page no.1 to 68.

The applicant bank has fully corroborated the averments made in the O.A. Even otherwise the whole case of the applicant bank is based on the documents and the same have been duly approved.

The case filed by the applicant bank gone unrebutted and there is no question of disbelieving the case of the applicant bank has proved its case beyond reasonable doubts

In the light of the above discussions, the Original Application deserves to be allowed.

I, allow this OA and direct the defendants to pay to the applicant bank within a period of 30 days, jointly or severally, a sum of Rs.39,91,817.36 (Rupees Thirty Nine Lacs Ninety One Thousand Eight Hundred Seventeen and paisa Thirty Six only) as on 01.06.2024 along with pendentelite and future interest @9.86% per annum with monthly rest from 01.06.2024 and costs till the date of realization, failing which the aforesaid amount shall be recovered from the sale of the hypothecated vehicles namely TATA 1412HD BS VI having Registration no. DL1GE2428 & DL1GE2313, Chassis number MAT767257N5H10885 & .MAT767257N5H10883 Engine number 3.8SG181GXX813304 & 3.8SG18GXX813099. In

case of default, the same shall be recovered from sale of the moveable and immovable properties of defendants.

(II) The recovery certificate be issued forthwith and be sent the Recovery Officer, Debt Recovery Tribunal-I, Delhi.

(III) Parties are directed to appear the Recovery Officer, DRT I, Delhi on 27.02.2026.

(IV) Copies of final order as well as Recovery Certificate be sent to all concerned free of cost.
