The Applicant Bank fired the present oA for the recovery of a totar sum of Rs.40,75,920.58ps as on 09.08.2024 from the defendants jointly and severarry with future interest @24o/o p.a. with monthry rests from the date of apprication tiil the date of rearisation arong with costs.

Summons served on D1 to 3. They were set ex-parte 06.08.2025 as called absent and no representation.

The Applicant Bank examined Akash Ghosh, Legal Manager as AW_1 and marked 15 documents through him as Ex. A.1 to Ex. A.15.

4' Heard the Ld. counser for the Appricant Bank, perused the materiar placed on record.

The point that arises for consideration is:_

Whether the Applicant Bank is entiiled for the claim made in the OA against the Defendants?

6' As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupred with the recitars in the documents viz., Exs. A.1 to A.15 marked on beharf of the Appricant Bank crinches the craim of the Appricant Bank against the Defendants. Hence, I hold that the Defendants are jointly and severally liable to pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Application No.422/2025 is allowed as under: fi.rrO

i) The Defendants are joinily and severaily riabre to pay to the Appricant Bank a sum of Rs.40,75,g2o.58ps with future interest @17.50o/o p.a. simple, from the date of application till the date of realization;

ii) the applicant bank is also entiiled to proceed against the person and properties of the defendant for realization of its dues;

iii) the appricant bank is entiued for the costs.

B' The Applicant Bank is directed to file Cost Memo within 2 weeks from the date of receipt of this Order.
