The Applicant Bank filed the present oA against Defendant for recovery of a total sum of Rs.53,16,091.33 Ps. (Rupees Fifty Three Lakhs Sixteen Thousand Ninety One and^paise Thirty Three Only) i.e a total sum of Rs.5i,97,1S8.33 ps under Housing Loan and Rs.1,28,933.00 Ps under lnsurance Premium Loan together with the current and future interest @8.7%^{plus 2% overdue lnterest p.a} from the date of this application till the date of realization and in default for sale of Mortgage Property as mentioned in the Schedule I to OA.

availed insurance premium of Rs.1.38,115/- on^05.09.2023 together with interest @9.35Yo^{p.a and executed loan documents} in favor of the Applicant Bank. The Defendant^{createdequitable} mortgage morefully mentioned in Schedule of Property^{I to OA} and executed Memorandum of Deposit of Title^{deeds dated} 28.08.2023 and deposited original Sale^{Deed in favor of the} Applicant Ban After availing the^{loan facility,the defendant failed} to comply the terms of sanction, hence^{the applicantbank} classified the account as NPA on 29.05.2025 and^issued Demand notice dated 31.05.2025 under^{Section 13(2) of the} SARFAESI Act, 2002 to the defendant.^{lnspite of several} requests and demands, the defendant did^{not clear the} outstanding. Hence this OA.

Defendant remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A.1 to A.17. ln view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendant and hence the Applicant Bank is entitled to recover the claim made in the OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under^:

The Defendant is liable to^pay to the Applicant^{Bank a total sum} of Rs.53,16,091.33 Ps.^(Rupees Fifty Three Lakhs Sixteen Thousand Ninety One and Paise Thirty Three Only)^{i.e a} total sum of Rs.51,87,158.33 Ps under Housing Loan^and Rs.1,28,933.00 Ps under lnsurance Premium Loan together with the current and future interest @8.7o/o p.a from^{the date of} this application till the date of realization.

The Applicant Bank is entitled to^proceed against the^Mortgaged Property mentioned in the Schedule Property I to the^OA towards realization of the debt due.

The Applicant Bank is also entitled to^proceed against the^person and^properties of defendant towards realization^{of the debt due.}
