- The Applicant Bank filed the present OA against Defendants No. 1 to 3 for recovery of a total sum of Rs.2,01,54,21g.46 ps. and Mortgaged properties as mentioned in the Schedules of Properties A and B to OA.
As per the averments in the application, the Applicant Bank states that Defendant No. 1 is a proprietorship firm represented by its Proprietor and also a borrower/guarantor and Defendant No. 3 stood as a guarantor. The Appricant Bank contended that the Defendants avaired Loan facirity of Rs.1.g0 crores with interest @8.30o/op.a with monthly rests and executed Hypothecation Agreement of Goods and Debts dated 02.0g.2020 in favor of the Applicant Bank. The defendant No. 3 created Equitable Mortgage morefully mentioned in Schedule of property B to the OA and executed Memorandum of Record of Deposit Tifle deeds on 27.08.2020 and deposited Sate Deed in favor of the Applicant Bank. The Defendant No.3 stood as a guarantor and executed Deed of Guarantee dated 02.09.2020 in favor of the Applicant Bank. The Defendants renewed the above mentioned credit facilities from time to time and executed necessary documents in favor of the Applicant bank. After availing the loan facility, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NpA on 26.05.2025 and issued Demand notice dated 06.08.2025 under 13(2) of the SARFAEST Act, 2OO2 to the I requests and demands, the 4\ mts did utstanding.
