IA no.136/2025 has been filed by the applicant bank for withdrawal of the present OA.
The Ld. Counsel for the applicant bank submits that the applicant bank was approached by the defendants vide email dated 09.04.2024 for settlement of outstanding dues in the account defendant No. 1. Pursuant to the request for OTS, the applicant bank issued an OTS sanction letter dated 30.09.2024 to the defendants sanctioning the One Time Settlement of the account of defendant No. 1. Terms of the OTS Ietter dated 30.09.2024 have been duly accepted by the defendants herein.
That the entire settlement amount stands deposited by the defendants with the applicant bank within theperiod specified in the OTS Letter dated 30.09.2024. The applicant has issued Letter of No Objection Certificate dated 05.1 L.2024 and 27.t2.2024 to the Borrower Company bearing Reference No. N OC/ PrY 0092498 I 2024- 25 a nd N OC/ PrY0092498 I 2024-25 .He further submits that he wish to withdraw the present OA. Ld. Counsel for applicant bank alsoprayed for: refund of the court fee.
In view of the above submission made by the Ld. Counsel for applicant banlq IA no.L3612025 is allowed. C,A137612024 is dismissed as withdrawn, being amicably settled. Registry is directed to return the couft fee as per rules. All the pending IAs stand disposed of.
The date already fixed on 24.02.2025 before Registrar stands cancelled.
