documents vlz., Exhtbtts Annexure-Alto Exhtbtt Annexure_A_s marked on behalf of the applicant Bank, establlshed the claim of the appllcant Bank agatnst the defendant and OA schedule properties. Hence, I hold that the defendant ts liable to pay to the applcant Bank the clahs made h the OA wtth future lnterest and costs.

(1)o.A.359of2023flredbytheapprcantBankrsalowedanddebtrsdetermrnedwrthcost against the defendant. It ls hereby ordered that applicant Bank is enuued to .ecover from the defendant the total amount to the tune Rs.20,71,S84,93 (Rupees Twenty Lakh Seventy One Thousand Five Hundred Elghty Four and Ntnety Three palse onty) with pendente fite and future rnterest @ 11,9590 pe. annum rnterest wlth simple on the amount due from the date offlllng ofthe Orlginal Appltcauon l,e, f6/OS/2023 till full and flnal realizaflon ofthe clalm amount,

(2) Amount, if any, paid by the defendant in the roan accounts or amount? If any, recovered by the app'cant Bank after firing of the o.A. the same be taken Into account whire arrrving at the exact amount of dues/debt payable by the defendant. Accordingty, pendente lite and future lnterest shall be calculated on the reduced amount.

(3) Defendant ls debarred from dtspostng, allenaflng or deallng wtth any of the properfles belonglng to them till the aforesald decretal debt ls recovered from the defendant.

(4) Oefendant ts gtven a me of thlrty days from the date of the JudgmenvFinat Order for repaylng of the above mentioned dues, so rntimated to him. In case the defendant fairs to pay the dues within the above mentioned Ume, the appllcant Bank ls enflUed to recover its dues by sale of secured assets, tf any. Appltcant Bank is also entifled to proceed agajnst personal properties of the defendant (Both movable and lmmovable) and also proceed agalnst the defendant personally to recover the dues ln accordance with law.

(5) Let the Certlftcate of Recovery be drawn up by Ld. Reglstrar forthwtth in terms of Judgment for lssuance of the same agalnst defendant ln favour of the appllcant Bank under Section 19(22) of the Recovery of Debts and Bankruptcy Act, 1993 and put up the same for issuance of the Certificate.

(6)Ld, Recovery Offlcer shall reallze the amount as p€r the Recovery Cer flcate from the defendant ln accordance with law.
