The Applicant Bank filed the present OA for the recovery a total sum of Rs.1,08,21,110.91ps as on 31.05.2024 in A/c.No.110515010000005 from the defendants joinUy and severally with future interest G)8.20olo p.a. from the date of application till the date of reallzation along with costs and in default for sale of OA schedule properties.

WS was forfeited on 29.01.2025 and DE was forfeited and exparte on 10.09.2025 as called absent and no representation.

The Applicant Bank examined Malapati Kirshna Reddy, Branch Manager, as AW-1 and marked 16 documents through him as Ex. A.1 to Ex. A.16.

Ld. Counsel for the Applicant Bank reported no oral arguments. Perused the written arguments and material placed on record.

The point that arises for consideration is:-

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendants and OA schedule properties? ffi"9

As stated supra, the^{Defendants remained ex-parte'The} Evidence Affidavit^{coupledwith the recitals in the documents} viz., Exs.A. 1 to A.16^{marked on behalf of the ApplicantBank} clinches the claim^{of the Applicant Bank against the Defendants'} Hence, I hold^{that the Defendantsare jointlyand severallyliable} to^pay the OA^{claim to the Applicant Bank with futureinterest} and costs.

In the result, the^{present Original Application No'342/2024is} allowed as under:^-

i) The Defendants are^{jointly and severally} liable to^pay to the^{Applicant Bank a sum of} Rs.1,08,21,110.91ps as on^31.05'2024in A/c.No.110515010000005^withfuture interest @8.20%^{p.a. simple from the date of} application till the^{date of realization;}

ii) the OA claim is secured^{by way oF mortgage} of properties described^{in the schedule} annexed to the OA^{and the applicant bankis} entitled to^proceed against the^{same to} realise its debt;
