The Applicant Bank has filed the present application for the recovery of a sum of Rs. 23,62,30,339.88/- (Rupees Twenty Three Crore, Sixty Two Lacs, Thirty Thousand, Three Hundred Thirty Nine and Eighty Eight Paisa only), along with future interest from the date of filing of the Original Application, i.e., 25.06.2022, until the date of realization of the entire outstanding dues from the Defendants.

Brief facts of the application are as under:

The Applicant Bank states that the Defendants No. 1 had approached and requested the Applicant Bank for SOD Limit (Project Overdraft). Upon considering the request and financial needs of the Defendant, the Applicant Bank Sanctioned SOD Limit of Rs. 500 lacs vide sanction letter dated 25.03.2015 on certain terms and conditions. The agreed rate of interest for the aforesaid loan facilities was @13.50% p.a. with monthly rests. The

Defendant also agreed to pay additional interest by way of liquidated damages in the event of any default in repayment.

That, thereafter the defendant has approached the bank seeking financial assistance. The applicant bank after scrutinizing and verifying the request of the defendant, the applicant bank has sanctioned secured overdraft facility (renewal/enhancement) of Rs. 16 Crore vide sanction letter dated 26.02.2016 on certain terms and conditions. The agreed rate of interest for the aforesaid loan facilities was @13.50% p.a. with monthly rests. The Defendant also agreed to pay additional interest by way of liquidated damages in the event of any default in repayment.

That, thereafter the defendant has again approached the bank seeking financial assistance. The applicant bank after scrutinizing and verifying the request of the defendant, the applicant bank has sanctioned secured overdraft facility (renewal/enhancement) of Rs. 16 Crore vide sanction letter dated 31.07.2017 on certain

terms and conditions. The agreed rate of interest for the aforesaid

loan facilities was @13.45% p.a. with monthly rests. The Defendant also agreed to pay additional interest by way of liquidated damages in the event of any default in repayment. The applicant bank has sanctioned Bank performance Bank Guarantee (enhancement of limit) for Rs. 7.55 Crore which is enhanced from 1.52 Crores.

The Defendant also agreed to pay additional interest by way of liquidated damages in the event of any default in repayment. The

applicant bank has sanctioned Bank performance Bank Guarantee (enhancement of limit) for Rs. 7.55 Crore which is enhanced from 1.52 Crores.

That, thereafter the defendant once again approached the bank seeking financial assistance. The applicant bank after scrutinizing and verifying the request of the defendant, the applicant bank has sanctioned secured overdraft facility (renewal/enhancement) of Rs. 16 Crore vide sanction letter dated 30.04.2019 on certain terms and conditions. The agreed rate of interest for the aforesaid loan facilities was @13.70% p.a. with monthly rests. The Defendant also agreed to pay additional interest by way of liquidated damages in the event of any default in repayment. The applicant bank has sanctioned Bank performance Bank Guarantee (enhancement of limit) for Rs. 4.35 Crore which is enhanced from 1.52 Crores & letter of credit (ILC Fresh) for Rs. 6

The applicant bank states that, the defendant once again approached the bank for restructuring of facilities seeking financial assistance. The applicant bank after scrutinizing and verifying the request of the defendants, the applicant bank has sanctioned the limits on 20.03.2021 which are as follows

The defendant has requested for restructuring of the existing OD limit by reducing the limit to Rs. 3.35 Crores out of total outstanding of Rs. 19.74 Crores. The remaining irregular portion of Rs. 16.39 Crores in carved out as WCTL which is repayable in 84 months. The Respondent has also requested for FITL for

interest portion during moratorium period for WCTL which is worked out to Rs. 1.85 Crores vide sanction letter dated 30.04.2019.

The defendant have agreed to pay interest @10.80% @11.30% p.a. & 10.90% p.a. respectively on loans with monthly rest and costs.

In order to secure the aforesaid loan facilities, the Defendant executed various loan documents in favour of the Applicant Bank. These included sanction letters, letters of consent, letters of undertaking, composite agreements, demand promissory notes, letters of continuity, deeds of hypothecation and mortgage deeds bearing day book nos. 4091-2015, 1379-2015, 1053-2016 & 1376-2016 dated 09.12.2015, 26.03.2015, 30.03.2016 & 11.05.2016 etc. Additionally defendant no. 2 to 12 stood as guarantors for defendant no. 1 and executed deeds of guarantee in favour of the applicant bank.

The Applicant Bank further contends that, in order to secure the aforesaid loan facility, the Defendants created first charge over their immovable propertis under mortgage deeds bearing day book nos. 4091-2015, 1379-2015, 1053-2016 & 1376-2016 dated 09.12.2015, 26.03.2015, 30.03.2016 & 11.05.2016 in favour of the Applicant Bank. The mortgage was created in respect of the following properties-

i) All that piece and parcel of plot no. P-141, admeasuring 1750 sq. mtrs., situated at additional MIDC area harangul (BK) Taluka and District Latur owned Maharashtra Mangal Seva Kendre Through its proprietor sattar saheblal shaikh, which is bounded as under:

The applicant bank contended that the defendants have failed to keep their promise and commitments agreed by them with regard to due repayment of the loan amount. The defendants failed to operate the loan account properly and failed to pay the agreed rate of interest as per terms and conditions of the sanction letter. Thereafter, the applicant bank repeatedly made demand of loan amount and called upon the defendants to pay with the agreed rate of interest thereon, but the defendants failed and neglected to pay the same. The loan account of the defendants became irregular and classified as NPA on 05.09.2021. Therefore on 07.09.2021 the applicant bank issued legal notice to the

defendants through their advocate. Despite service of Notices, the defendants failed and neglected to repay the outstanding dues of the applicant Bank. Hence, this application is filed.

The defendant Nos. 1 to 5, 10 to 12 appeared in matter but failed to file written statement, whereas defendant nos. 6 to 9 failed to appear in matter though they were served through court commisioner. Hence the right of defendant Nos. 1 to 5, 10 to 12 to file written statement stands closed and defendant nos. 6 to 9 were proceeded ex-parte as per order dated 30.07.2025.

The applicant Bank has filed Claim Affidavit of evidence at Exhibit-4 of Rohit Shyamsukha, Chief Manager of the applicant Bank, and has produced on record the original loan transaction documents as Annexure, A-1 to A-75 along with list of documents Exh.5 which corroborates the case of the applicant Bank.

I have heard arguments of the learned Advocate for the applicant Bank.

Since the defendants failed to appear and contest the application, I find no reason to disbelieve the unrebutted evidence of the applicant Bank. Therefore, the applicant Bank is entitled for the reliefs as claimed.

The applicant Bank has claimed charge over immovable properties of the borrowers / defendants which are mortgaged in favour of the applicant bank.

¶180

The applicant Bank has claimed future interest @11.30 % p.a. on outstanding amount from the date of filing i.e. 25.06.2022 of this application till realization of the claim amount. However, considering the facts of the case, I am of the opinion that if future interest is granted @ 10% per annum (simple) on outstanding amount, it would be just and reasonable rate of interest.

(B) The defendants shall pay jointly and severally to the applicant Bank a sum of Rs. 23,62,30,339.88/- (Rupees Twenty Three Crore, Sixty Two Lacs, Thirty Thousand, Three Hundred Thirty Nine and Eighty Eight Paisa only), along with future interest @ 10% per annum (simple) from the date of filing of the O.A. i.e. 25.06.2022 till full payment/realization of the amount mentioned in this operative order.
