The Applicant Bank filed the present OA against Defendant for recovery of a total sum of Rs.24,98,27S.00/- (Rupees Twenty Four Lakhs Ninety Eight Thousand Two Hundred and Seventy Five Only) with future interest @ 12.85% p.a with monthly rests as on27.05.2025 tillthe date of realization and in default for sale of the Hypothecated Assets as mentioned in the Application A Schedule to OA.

As per the averments in the application, the Applicant Bank states that Defendant availed Open Cash Credit Loan of Rs.25.00 Lakhs with an interest @ 12.85o/o p.a with monthly rests and executed . .'Agreenr4g! 1.' _ :,.,for Open Cash Credit on 19.10.2023. Sri. Sachin Kumar, Principal Officer of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.13

The Defendant is liable to pay to the Applicant Bank a total sum of Rs.24,98,275.00/- (Rupees Twenty Four Lakhs Ninety Eight Thousand Two Hundred and Seventy Five Only) with future interest @ 12.85% p.a with monthty rests as on 27.05.2025 till the date of realization.

The Applicant Bank is entiiled to proceed against the Hypothecated Assets mentioned in the Application A Schedule to the OA towards realization of the debt due.

The Applicant Bank is also entifled to proceed against the properties of defendant towards realization of the debt due.

That Applicant Bank is entitled to the costs of the OA.
