This is an application under section 19 of the Recovery of Debts Due to Banks and Financial lnstitutions Act, 1993 liled by the INDIAN BANK, Sibsagar Branch, MaMari Patty, Opposite Central Market, J. P. A few facts giving rise to the present application are as under.

On 18.08.2020, the Dofendant no. 1 represented by its proprietor being Oefendant No.2 approached and applied to the ApPlicant Bank for financial assistance by way of Term Loan under Pradhan^{Mantri MudraYo.ianafor its} business and^{giving all nec€ssary details to the ApPlicant Bank}

meeting day to day working capitat of the firm approached and applied to the applicant bank for GECLS credit facility by way of Term Loan for Rs.2,1S,OOO.OO under IND-GECLS (Extension) Scheme by submitting a loan application dated 27.10.2021 for his civil contract works, plying of vehicle on hire basis business and giving all necessary details to the Applicant Bank.

The applicant bank on consideration of the said applicalion datad 27.10.2021 sanctioned Mudra GECLS 1.0 Extension by way of Term Loan of Rs.2,1S,OOO,OO to the Oefendant No.1 vide Sanction Letter daled 29..10.202,1. The terms and conditions of the Sanction Letter dated 29.10.2021 was duly accepted and acknowledged by the Defendant No. 2 being the^proprietor of the Oefendant No.1. As pef the terms of Sanclion: -

a) ThB rate of inlerest shall be charged in the said Term Loan (GECL) Account at the rate of 3.50% spread per annum over the 4.OO% Repo Rate. The effective rate of interest at the time of sanction stood at 7.SO % per annum, calculated on daily balance with monthly rests subject to changes from time to time.

b) The Term Loan shall have to be repaid in 60 equal monthly lnstallments of Rs. 4,800/- per month. (Moratorium period of 6 months) as such the first insta ment commenced from May, 2022.

c) The said Term Loan shall primarily be secured by the hypothecation of assets created out of bank fund (More fu y descdbed in the Schedule _A(i) of the oA).

The aforesaid and other terms and conditions were accepted and acknowledged by the Defendant No. 2 being the proprietor of the Defendant No.1 .

The defendant No.'l represented by the Oefandant No.2 availed the aforesaid Term Loan (lNO GECLS Extension) of Rs.2,15,OOO.OO from the applicant bank and had executed the following loan documents in favour of the Applicant Bank on 29.10.2021 and agreed to the terms and conditions recited therein:_

The defendant no. 1 represented by its proprietor being Defendant No. 2 approached and applied to the applicant bank for MSME Loan by way of Term Loan for Rs.55,00,000.00 under Credit Guarantee Fund Trusl for Micro and Small Enterprise Scheme (CGTMSE) by submitting a loan application d aled 27.Og.2022lot purchasing Hyundai Hydraulic Excavator and other construction work and giving all necessary details to the Applicant Bank.

The applicant bank on consideration of the said application dated 27.09.2022 sanctioned Term Loan of Rs.55,00,000.00 to the Defendant No.1 for purchasing of Hyundai Hydraulic Excavator which is covered under credit Guarantee Fund rrust for Micro and Small Enterprise Scheme (More fully described in the Schedule- A (ii) of the oA) vide sanction Letter dated '14.10.2022. The ierms and conditions of the Sanction Letter dated 14.10.2022 was duly accepted and acknowledged by the Defendant No. 2 being th6 proprietor of the Oefendant No.i. As per the terms of Sanction: -

a) The rate of lnter€st shall be charged in the said Term Loan Account at the rale of 3.20o/o spread per annum over the s.go% Repo Rate. The effective rate of interest at the time of sanction stood at 9.10 % per annum, calculated on daily balance with monthly rests subject to changes from time to time.

b) The Term Loan shall have to be repaid in 60 equal monthty installments of Rs. 1,16,000/- per month. (Moratorium period of 2 months).

c) The said Term Loan sha primarily be secured by hypothecation of Hyundai Hydraulic Excavator Model R 21S (More Fully described in the Schedute_ A(ii) of the oA).

The aforesaid and other terms and condilions were accepled and acknowledged by the Defendant No. 2 being the proprietor of the Defendant No.1.

The defendant No.1 represented by the Defandant No.2 availed the aforesaid Term Loan of Rs.55,00,000.00 from the applicant bank and had executed the followino loan documents in favour of the Applicant Bank on 17.102022 and agreed to the terms and conditions recited therein:*-dra^

ln pursuance of the execution of the documents as stated above Term Loan Account Nos. 58003945348, 7107450835 and 7320681359 were opened by the Applicant in lhe name of the Oefendant No.1. The aforesaid cradit facilities were disbursed as per the requirements of the Defendants. All the transactions made by the Defendants including withdrawal of money, lnterest, rcpaymants etc. ware duly entered and recorded in loan accounts maintained in the ledger of the Applicant Bank in its ordinary and usual course of their banking business.

After some time it was observed that the above Term Loan Accounts became irregular. The Defendants failed and/or neglected to operate lhe Loan Accounts properly as per the terms and conditions of sanclion and the loan documents, the interest charged in the accounts were not served regularly, the transactions were very less in th6 accounts, the transactions in the accounts were nol at all satisfactory, followed by non-deposit of irregular amounuinstallments/outstanding dues in the loan accounts and Defendants failed and/or neglected to regularize the accounts inspite of repeated requests, reminders of lhe Applicant and also on personal approaches made by the Bank. Various measures were lnitiated viz visits, personal discussions and through letters and phone, lo recover the irregular amounuoutstanding dues. But, the defendants failed to repay the outstanding amount in the loan accounts. The Applicant gave many opportunities and requested many times to the Oefendant No.2 as proprietor of the Oefendant No.1 for the repayment of the outstanding dues but the Defendants did not show any interest in keeping his own commitments to clear the irregular amounvoutstanding dues in the Loan Accounts and all previous promises turned out to be false.

Despite of regular requests and follow ups by the Applicant Bank, the Oefendants wer6 neither operating the loan accounts^properly nor were defendants regularizing the overdue / irreguler amount in the Term Loan Accounts. The

Defendant No.2 as proprietor of the Defendanl No.1 every time gave false assurances and did not keep his word. As a result thereon the all three Term Loan Accounts were classified as NPA (Non-Performing Asset) on 13.09.2023 as per the guidelines of Reserve Bank of lndia because of non-paymenl of interest, principal amount, installment and non-regularization of the aforesaid Term Loan Accounts.

ln view of such circumstances, the Applicant at first on several occasions requested the Oefendants to regularize the loan accounts lmmediately. That the applicant bank vide letters dated 01.08.2023, 01.09.2023, 't5.09.2023 to the Defendants demanded for repayment of the irregular / overdue amounl in the Term Loan Accounts. The applicant bank sent also Legal Notice of demand through its lawyer's lo the defendant on 05.09.2023 demanding payment of the outstanding dues with lnterest of both the loan accounts but the defendants have failed to repay the outstanding dues in the loan accounts with interest. The defendants inspite of having received lhe said letters failed to repay the lrregular overdue amount in the loan accounls and have failed to regularize the loan accounts.

The Defendant No. 1 represented by its proprietor being Defendant No.2 has admitted, acknowledged and confirmed his liability in the ierm loan account no. 58003945348 on 30.08.2023, 25.09.2023 by making last repayments in the toan account on the said dates and in the term loan account no. 7107450835 on 25.09.2023 by making last repayment in the loan account on the said date and in the term loan account no. 7320681359 on 17 .05.2024 by making last repayment in the loan account on the said date and the last loan documents were executed by the Defendant No.2 as proprietor of the Defendant No.1 on '17.'10.2022.

All lhe transactions made by the Defendants including deposit of money etc. are duly entered and recorded in the Term Loan accounts maintained in the books of accounts of the Applicant Bank in its ordinary and usual courso of banking business.

ln the Term Loan Account No. 58003945348 the total amount payable is Rs.4,26,672.51 as on 30.06.2024. The rate of interest has been charged in the Term Loan Account according to the variations of the rates as fixed from time to time by the Reserve Bank of lndia as reflecting in the account maintained by the Applicant

Bank in the usual and ordinary course of the Banking Business. The penal interest capitalized in the Term Loan Account No. 58003945348 being Rs.425.00 is deducted from the claim amount made by the applicant bank in the Original Application and the same is deducted from the balance as on 13.09.2023 being Rs.4,11,609.47 and is reflected in the second entry made in the calculation of unapplied/unrealized lnterest calculation and the said entry is^prior to the application of the unapplied/unrealized interest calculation. The interest accrued but not applied from 14.09.20231o 30.06.2024 at different rates from time to time as^per rate fixed by the applicant bank is Rs.37,488.04. The applicant bank has charged the interest after taking into consideration the related transaction of the said^period. Thus, the total amount due to the applicant bank inclusive of lnterest upto 30.06.2024 is Rs.4,26,672.51. The applicant bank has filed the statement of the Term Loan Account No. 58003945348 duly certified by the Chief Manager of the applicant bank. The applicant bank has also filed herewith unapplied interest calculation of interest on the^payable amount of the abovementioned Term Loan Account^{from '14.09.2023} to 30.06.2024 duly certified by the Chief Manager of the applicant bank.

ln the Term Loan Account No. 7107450835 the total amount^payable is Rs.1,28,567.75 as on 30.06.2024. The rate of interest has been charged in the Term Loan Account according to the variations of the rates as^{fixed from time to timeby} the Reserve Bank of lndia as reflecting in the account^{maintained by the Applicant} Bank in the usual and ordinary course of the Banking Business.^{The penal interest} capitalized in the Term Loan Account No.^{7107450835 being Rs.2.00is deducted} from the claim amount made by the applicant bank in the Original^{Applicationand} the same is deducted from the balance as on^{'13.09.2023being Rs.1,29,419.00and} is reflected in the second entry made in the calculation of^{unapplied/unrealized} lnterest calculation and the said entry is^prior to the^application of^the unapplied/unrealized interest calculation. amount due to the applicant bank inclusive of interest upto 30.06.2024 is Rs.1,28,567.75. The applicant bank has fited the statement of the Term Loan Account No. 7107450835 duly certified by the Chief Manager of the applicant bank. The applicant bank has also filed herewith unapplied interest calculation of interest on the payable amount of the abovementioned Term Loan Account from 14.09.2023 to 30.06.2024 duly certified by the Chief Manager of the applicant bank.

ln the Term Loan Account No. 7320681359 the total amount payable is Rs.52,91,071.70 as on 30.06.2024. The rate of interest has been charged in the Term Loan Account according to the variations of the rales as fixed from time to time by the Reserve Bank of lndia as reflecting^jn the account maintained by the Applicant Bank in the usual and ordinary course of the Banking Business. The penal interest capitalized in the Term Loan Account No. 7320681359 being Rs.2428.00 is deducted from the claim amount made by the applicant bank in the Originat Application and the same is deducted from the balance as on 13.09.2023 being Rs.50,76,909.00 and is reflected in the second entry made in the calculation of unapplied/unrealized interest calculation and the said entry is prior to the application of the unapplied/unrealized interest calculation. The interest accrued but not applied lrcm 14.09.20231o 30.06.2024 at different rates from time to time as per rate fixed by the applicant bank is Rs.3,96,590.70. The applicant bank has charged the interest after taking into consideration the related transaction of the said period. Thus, the total amount due to the applicant bank inclusive of interest upto 30.06.2024 is Rs.52,91,071.70. The applicant bank has filed the statement of the Term Loan Account No. 7320681359 duly certified by the Chief Manager of the applicant bank. The applicant bank has also filed herewith unapplied lnterest calculation of interest on the^payable amount of the abovementioned Term Loan Account: f.om 14.09.2023 to 30.06.2024 duly certified by the Chief Manager of the applicant bank.

All the aforesaid 03 (Three) Term Loan Accounts of the Defendant No.1 as stated above taken logether the Defendant Nos.'l and 2 are Jointly and severally liable to pay to the applicant bank an amount of Rs.4,26,672.5'l + Rs.1,28,567.75 + Rs.52,91,071 .70 total a sum of Rs.58,46,31 1 .96 as on 30.06.2024.. Bank is also entitled to a further interest from 01.07.2024 al the rate of 1 1 .55% per annum in the Term Loan Account No. 58003945349, at the rate of 9.2S% per annum in the Term Loan Account No. 7107450935 and at the ,?le of g.ZTo/o per annum in the Term Loan Account No. 7320681359 with monthly rest to till the date of the realization of the amounts in full, along with all costs and incidental expenses, pendsnuite interest and future interest which the said Defendant Nos.i and 2 are jointly and severatly liable to pay to the Applicant Bank.

The applicant bank thus became @nstrained to fite the piesent Original Application for the recovery of Rs. 58,46,311.96 (Rupees Fifty-Elght Laca Forty_Six Thousand Thrse Hundred Elevsn and paisa Ninsty_Six) only as on 30.06.2024 along with interest and cost of the application.

After filing of the OA the Tribunal issued notices upon the defendants fhrough registered post and the applicant bank filed service report on 05.09.2024 and brought on record the postal receipts along with track consignment report which shows that notices have not been served upon the defendants. Hence, service was not completed against the defendants. Thereafler, the Tribunar ordered to take steps through substituted service of notice in two widely circulated local newspapers. On, 28j0.2024 the learned counsel for the applicant bank has fibd fhe service report of paper publication showing publication notice in the newspapers namely "Ihe f,rnes of lndia' and "Dainik Assam" both dated 1Z .0g.2024. Even afier publication of notice also there was no rapresentation on behalf of the defendants either through any counsel or in person. Hence, the defendants were set ex_ pane on 09.12.2024 and their right to tile Written Statement cum Evidence on Affidavit was closed and the matter was posted for hearing on behatf of the applicant bank.

Recovery Certificate against the defendants as per pleadings made in the Application, supported by evidence on affidavit of their witness who affirmed on oath the execution of the security and other documents by the defendanB and also execution of their own documents relied upon, which have been marked exhibits.

Considering the facts and circumstances .of the case, I am of the considered view that the documents filed by the applicant bank are supporting the claim of the applicant bank and establishing the liability of the defendants. lt is proved that the defendants are^jointly and severally liable to pay to the applicant bank the claim made in the Original Application. The loans were obtained and documents have been ex€cuted on 21.08.2020, 29.10.2021, 14.10.2022 & 17.i0.2022. The toan accounts became NPA on 13.09.2023 and the OA has been filed on 09.07.2024. Hence, the OA is filed well within the period of limitation and this Tribunal having a jurisdiction to adjudicate the Original Application.

Considering the unchallenged / unrebutted version of Sri Suman Kumar, the applicant's witness and all the documents marked as exhibits, including duly certified copy of the statement of account along with interest calculation sheet maintained by the applicant Bank in it's regular course of business, I hold that the applicant is entifled to get the Recovery Cedificate as prayed for.

ln the resull, the present Original Application No. 296 of 2024 is allowed with cost as under :-

The defendants No. 1 & 2 are jointly and severally liable to pay to the applicant bank a sum of Rs. 58,46,311.96 (Rupe€ Fifty-Eight Lacs Forty-Six Thousand Throo HundrEd Elsven and paisa Ninety-Six) only with pendentelite and future interest @11.550/0 per annum in the Term Loan Account No. 58003945348, @9.25% per annum in the Term Loan Account No. 7107450835 and @9.70o/o per annum in the Term Loan Account No. 7320681359 with monthly rests from 01.07.2024 till the date of full paymenurealization and also cost of the application.

debts and vehicles and all other movable assets of the defendant no.1 lncluding receivables, documents of tifle to goods, outstanding monies, bills, invoices documents, contracts, insurance policies, guarantees, engagements, securities, investments and rights and the present machinery and all the future machinery belonging to or in the possession or conlrol of the defendant no.1 or of any third party whether in lndia or elsewhere including all such goods, vehicles, other movable assets as may be in the course of shipment, transit or delivery and all the machinery, vehicles and other equipment items, stocks of whatever nature acquired by the defendant no..l in ils premises at B. G. Road, Opposite ONGC Fire Station, District- Sibsagar, Assam, pin_785640 or elsewhere;

(2) A Hyundai Hydraulic Excavator Model No. R21S bearing Serial Number: HYNDN640CE000877, Engine No.22CAg7jtg2, yeat ol Manufaclwe: 2022, Maker's Name- Hyundai, as described in Schedule_A of the OA till the amount is realized in full.

iii) The applicant bank is entited to proceed against the secured items towards recovery of the debts.

iv) The applicant bank is also entifled to proceed against the personal assets and properlies of the defendants towards recovery of the dues.

v) The applicant bank is entifled to the cosfs of the O.A. which includes the advocate faes of the applicant bank. Applicant is direcied to file the cost memo within 2 weeks from today.
