Defendant No.1 is proprietorship firm and principal borrower and defendant No.2 is Sole Proprietor of defendant No.1 Firm. As per the loan application of the defendants, the applicant Bank sanctioned the Term loan facility of Rs.27,00,000/- to the defendants under CGTMSE scheme vide Sanction Letter dated 01.03.2019.
In order to secure the aforesaid loan facility, the defendants executed necessary loan and security documents along with deed of hypothecation, in favour of the applicant Bank.
Thereafter, at the request of the defendants, the applicant Bank restricted the Term Loan for Rs.28,68,366/- and opened Funded Interest Term Loan of Rs.3,22,692/- vide Sanction Letter dated 24.09.2019.

Thereafter, again at the request of the defendants as well as per directives of Government of India, in view of Covid-19 Pandemic, in SME accounts Short Term Loan of Rs.5,78,000/- was granted to the defendants vide Sanction Letter dated 27.07.2020.

Hence, I pass the following order.
O R D E R
B} Defendant Nos.1 and 2 either jointly or severally shall pay to the applicant Bank the sum of Rs.40,48,220/-

(Rupees Forty Lakhs Forty Eight Thousand Two Hundred Twenty only) along with future interest @9% per annum from the date of filing of the Original Application i.e. 30.09.2021 till full payment/realization of the amount mentioned in this operative order.
