The Applicant Bank filed the present oA against Defendants for recovery of a total sum of Rs.g5,35,413.6ops (Rupees Eighty Five Lakhs Thirty Five Thousand Four hundred rhirteen ancr paise sixty only) with interest @ 12.30% p.aplus 2o/o penal interest p.afrom 01.01.2025 till the date of realization.

As per the averments in the application, the Applicant Bank states that defendant no,1 availed term loan of Rs.93.50 lakhs for purchase of two hydraulic excavators of Hyundai make on 10,02.2023. Defendants no.2 to 6 stood as guarantors to the term loan and executed term I nt, letter of guarantee, memorandum of deposit of pu,.tqi ip deed and purchase invoices etc. f,i " i-;-:. Inspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.

Defendants called absent and set exparte on 15.07.2025.

Sri K. Kishore Kumar, Senior Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1to A.11.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant Bank is entitled for the claim made in the OA against the Defendants as prayed for?

Defendants remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited relevant documents as Ex.Al to A.11. In view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendants and hence the Applicant Bank is entitled to recover the claim made in the OA with future interest

The Applicant Bank is also entifled to proceed against the person and properties of defendants towards realization of the debt due.
