The Applicant Bank fiied the present OA for the recovery of a sum of Rs.56,28,1B1/- towards Loan A/c.Nos.52017265 & 52477064 from th. dcfr:ndants jointly and severally with future interest @17o/o p.a. from the date of apprication till the date of realization arong with (:osts.

Summon served on D1 to 3 through paper publication and was set ex-parte on 17.70.2024 as called absent and no representation.

J. A perusal of docket proceedings would reveal that the case had been posted for applicant bank,s evidence on (l)2g.ll.ZO24, (2)24.01..202s, (3)t8.02.202s, (4)04.03.202s, (5)2s.03.202s, (6)2s.04.2025, (7)18.06.2025, (B)23.07.2025 and finaly on (9)21.08.2025, Despite these many adjournments the applicant bank did not bother to adduce evidence. Even costs were not deposited as per order dated 2t.08.2025. As the applicant bank failed to evince any interest in pursuing the case, the right of evidence was forfeited on 21.08.2025 and matter was posted for orders.

The point that arises for consideration is:-

Whether the Applicant Bank proved its claim made in the OA against the Defendants?

As stated supra, the Defendants remained ex-parte and the right of adducing evidence of applicant was forfeited. The applicant bank Failed to substantiate its claim by leading evidence and marking the documents inspite of several adjournments and costs. Under such circumstances, I hold that the claim of the azrlicant bank remained

un-substantiated and not proved accordingly, OA is liable to be dismissed, without costs.

In the result, the present Original Application No.230/2024 fails and is hereby dismissed without costs.
