The Applicant Bank filed the present OA for the recovery a total sum of Rs.31,13,853/- i.e., a sum of Rs.5,84,891/- towards CKLS A/c.No.560941000091039 and a sum of Rs.25,28,962/towards CCCK A/c.No.550961000398849 from the defendant with future interest @13.85o/o p.a. with monthly rests from the date of application till the date of realization along with costs and in default for sale of OA schedu le proOertieffi,C

Summon served on sole defendant through^{paperpublication} and was set ex-parte on 25.09.2024 as called absent and no representation.

The Applicant Bank examined B.Dhanamjaya Reddy, Branch Manager, as AW-1 and marked 17 documents through him as Ex,A.1 to 8x.A.17.

Heard the Ld. Counsel for the Applicant Bank. Perused the material placed on record.

The point that arises for consideration is:-

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendant and OA schedule properties?

As stated supra, the Defendant remained ex-parte.^The Evidence Affidavit coupled with the recitals in the^documents viz., Exs.A. 1 to A.17 marked on behalf of^{the ApplicantBank} clinches the claim of the Applicant^{Bank against the Defendant.} Hence, I hold that the^{Defendantis liable to pay the OA claim to} the Applicant Bank with^{futureinterestand costs.}

In the result, the^{present Original Application No.2Q4/2Q24is} allowed as under:^-

i) The Defendant is liable to^{pay to the} Applicant Bank a sum of^{Rs.31,13,8531-i.e.,} a sum of Rs.5,84,891/-^towardsCKLS A/c.No.560941000091039 and a^{sum of} Rs.25,28,9621- towards^{CCCK^} A/c.^No' OW*P
