The learned counsel for the applicant bank filed application for withdrawal and submitted that the applicant has filed Original Application for recovery of Rs.35,15,360/-. Meanwhile, defendants had approached to bank for One Time Settlement. As per settlement arrived at, the defendants have deposited Rs. 1,43,000/- as the settlement amount as agreed with the applicant Bank, and loan account is closed. Hence applicant bank do not want to proceed further and wants to withdraw the Original Application. 2. The counsel requests for return of the original documents and also refund of the court fees as per rules. 3. Heard. 4. In view of the amicable settlement of loan account under OTS, I pass the following order. ORDER A. As the loan accounts are settled amicably and closed, the O.A. No. 6/2023 stands disposed of as withdrawn. |
